UR POV – TERMS AND CONDITIONS

1) ACCEPTANCE OF TERMS
By accessing or using UR POV, you agree to be bound by these Terms & Conditions together with the Privacy Policy and all notices or disclaimers published on the platform. If you do not agree, you must stop using the platform.
2) ABOUT THE SERVICE
UR POV is a paid, verified business-listing and rating platform operated by 245 Creative (Pty) Ltd. The platform enables the display of venue listings and allows users to view and submit reviews.
UR POV does not own, operate, control, manage, or act as agent for any listed venue.
3) USER RESPONSIBILITIES
Users agree to:
● Provide accurate and lawful information
● Not upload defamatory, misleading, harmful, or unlawful content
● Not interfere with the platform’s security or operations
● Comply with all applicable South African laws when using UR POV Users are legally responsible for all content they submit or publish.
4) BUSINESS LISTINGS & PAYMENTS
● Businesses may subscribe to list on UR POV according to published pricing Subscription fees are non-refundable once the listing is active Businesses are solely responsible for the truth, legality, licences and claims made in their listings.
Verification is limited to information supplied by the business — UR POV does not guarantee accuracy or ongoing compliance
5) USER-GENERATED CONTENT & REVIEWS
UR POV may host reviews or ratings submitted by users.
245 Creative (Pty) Ltd does not verify, endorse or assume responsibility for such content. We reserve the right, but not the obligation, to remove or disable content at our discretion or upon complaint.
We are not liable for any defamatory, incorrect or harmful statements posted by users.
6) INTELLECTUAL PROPERTY
● All UR POV branding, software, design, layout, UI and platform content remain the exclusive property of 245 Creative (Pty) Ltd
● Users retain ownership of content they upload, but grant 245 Creative a royalty-free, non-exclusive licence to display such content on the platform
7) LIABILITY DISCLAIMER
245 Creative (Pty) Ltd and UR POV are not liable for any loss, damage, injury, claim or incident of any nature arising from:
● Use of, reliance on, or interaction with listed venues
● Actions, omissions, negligence, conduct or safety at any venue
● User-generated content or third-party links
● Any incident arising before, during or after engagement with a listed business
Use of the platform and interaction with venues is entirely at your own risk.
8) TERMINATION & REMOVAL OF ACCESS
245 Creative (Pty) Ltd may suspend or terminate accounts, listings or access without prior notice where:
● These Terms are breached
● Fraud, abuse or unlawful conduct is suspected
● Platform integrity or safety is at risk
No refund is due in the event of termination for breach or misuse.
9) GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising shall be resolved under South African jurisdiction.

By using this website or app, you confirm that you are 18 years or older. 245 Creative (Pty) Ltd takes reasonable steps to restrict access by minors, but has no responsibility for false declarations of age or unauthorised access.
NATURE OF PLATFORM
UR POV is a business-listing and rating platform. Listings are verified to a reasonable extent based on information submitted by businesses. UR POV does not guarantee or warrant the accuracy, safety, legality, suitability, quality or continued compliance of any listed venue or service.
YOUR USE AT YOUR OWN RISK
Any visit to, reservation with, purchase from, or engagement with a listed venue is done entirely at your own risk. UR POV and 245 Creative (Pty) Ltd do not accept liability of any kind for:
• Loss, damage, theft or injury of any nature;
• Incidents, misconduct, negligence or unlawful acts at or by any venue;
• Personal harm, dissatisfaction, service failure, food/beverage effects, or other consequences of using listed businesses This exclusion applies to all direct, indirect, incidental, special or consequential loss or damages, whether foreseeable or not.
USER REVIEWS & SUBMITTED CONTENT
UR POV may contain content submitted by users. 245 Creative (Pty) Ltd does not verify or endorse user-generated reviews or statements and is not liable for defamation, inaccuracies, misrepresentations or reliance placed on such content. Users remain legally responsible for
what they publish.
THIRD-PARTY LINKS & PARTNERSHIPS
UR POV may contain links or references to third-party sites, services or partners. 245 Creative (Pty) Ltd does not control, endorse or assume liability for any information, service, conduct, product or experience accessed through such third parties.
NO PROFESSIONAL OR GUARANTEE CLAIMS
Content on UR POV is informational only and does not constitute a recommendation, guarantee, warranty or professional advice. Venues listed remain fully responsible for their own compliance, safety, licensing and conduct.
